Over-The-Counter medicines
Pharmacies and other legally authorized premises (designated as “pharmacie(s)”) may sell, deliver and dispense medicines not subject to medical prescription (“OTC”) and other health and/or beauty products, under the terms of and in compliance with the legislation in force, in particular Decree-Law no. 307/2007, of August 31 and Ministerial Order no. 1427/2007, of November 2. Exceptions refer to non-prescription medicines that have to be dispensed exclusively by pharmacies.
The sale, delivery and dispensing of OTC at home will be carried out under the supervision of a pharmacist or pharmacy technician, depending on whether it is a pharmacy selling OTC. Notwithstanding the above, users may request advice from a pharmacist by submitting a request directly via the Uber Eats App. On the merchant’s front page, users will also be able to find the correspondent telephone number.
OTC home delivery of medicines can only be assured by pharmacies and/or legally authorized premises. By placing an order, the user requests and declares that the sale, delivery and dispensation of the OTC Item is carried out under the above terms, directly to the home and/or address indicated by the user.
If the user so wishes, the pharmacy will also have available the ‘pick-up’ option, whereby the user collects the Item directly from the pharmacy.
The prices of non-prescription medicines, goods and/or services sold by the pharmacy through the Uber Eats App are the sole responsibility of the pharmacy and may not necessarily correspond to the prices charged in a physical store. If the user wishes to be invoiced with their tax identification number (NIF), they must indicate this number to the pharmacy via the Uber Eats App before completing the order.
The information necessary for the proper use of OTC is the responsibility of the technical director of the pharmacy or the technical manager of the legally authorized premise, as the case may be.
The following legally required information can be consulted and accessed via the pharmacy’s page and the respective product(s) on the Uber Eats App:
- Price of the services provided related to the sale of medicines and their home delivery;
- Accepted payment methods;
- Geographical area in which the pharmacy provides home delivery;
- Estimated time for delivery of the requested Items; and
- Name of the technical director of the pharmacy or the technical manager of the legally authorized premise.
When you place an order for an OTC Item with a pharmacy via the Uber Eats App:
- Said order constitutes an autonomous contract between the pharmacy and the user, to which Uber Eats is not a party to;
- The pharmacy will assume the obligation to deliver to the address indicated by the user, if the user so wishes;
- The user declares that the sale, dispensation and delivery is ensured and carried out under the supervision of the pharmacy, directly to the home and/or address indicated by the user;
- Any requests, demands or complaints relating to the contractual relationship between the pharmacy and the user must be dealt with directly between the user and the pharmacy;
The use of the Uber Eats App and the request of OTC Items from a pharmacy through it does not generate or constitute any obligation for Uber Eats within the scope of the contracts that may be concluded between the pharmacy and the user.
